The surface waters of the Rio Grande basin are fully appropriated. Any use of water in the basin requires a permit from the New Mexico Office of the State Engineer ("NMOSE"}. The State Engineer requires that any new use of water must be offset by a reduction in an existing use to ensure that senior water rights are not impaired.

In 1999, the International Boundary and Water Commission, U.S. Section (USIBWC) began a public scoping and consultation process to develop alternatives for an Environmental Impact Statement on river management of the Rio Grande Canalization Project (RGCP), the 105-mile project area from the Percha Dam near Arrey, NM downstream to the American Diversion Dam in El Paso, TX.
